109.9 Retained Percentage (for Sec 109.9)

Formal retainage is no longer designated by MoDOT as a routine part of the contract however 8.960 RSMo does allow up to 10% of the contract price to be retained in order to ensure performance of the contract. Payment may be withheld on any particular work item that has not been completed in accordance with the contract. This can include work incidental to the work item, and required documentation directly related to the work.
