Local Public Agency Policy
EPG 136 LPA Policy presents the very latest LPA information and this Word file may be helpful for those wanting to easily print the LPA information.

Please use the LPA Manual Change Request Form to request manual changes throughout the year or the Revisions Comments Form to make comments on proposed revisions.

136.14.1 Local Programs

Local Programs provides federal funding to cities and counties for their transportation improvements. Please refer to EPG 136 Local Public Agency Policy for guidance to utilize federal funding made available to local agencies through the programs listed below.

136.14.1.1 Transportation Enhancements (TE)

Transportation Enhancements District Contacts

This program provides funding through a competitive selection process for transportation related activities other than routine highway and bridge construction. For program details and project examples, click on the desired district, listed to the right, to access the TE Guide.

136.14.1.2 Off-System Bridge Replacement and Rehabilitation (BRO)

This program provides funding to counties for replacement or rehabilitation of deficient bridges.

136.14.1.3 On-System Bridge Replacement and Rehabilitation (BRM)

This program provides funding through a competitive selection process for replacement or rehabilitation of deficient bridges.

136.14.1.4 Congestion Mitigation and Air Quality (CMAQ)

This program provides funding for projects that improve air quality within Environmental Protection Agency designated areas.

136.14.1.5 Surface Transportation Program (STP)

Large Urban

This program provides funding for transportation facilities within the Transportation Management Areas of Kansas City, Springfield and St. Louis.

Small Urban

This program provides funding for transportation facilities within urban areas with an urban cluster population greater than 5,000.

136.14.5 Recent Changes to LPA Policy

11/30/11: The Obligation Request Form was updated in EPG 136.14.3.1 Commonly Used Forms. In EPG 136.6 Consultant Contracts, two forms were updated: Fig. 136.6.2 Criteria for Evaluating Consultants (which now includes additional guidance and deleted proximity from criteria) and Fig. 136.6.7 Sample Solicitation (which now includes the sample scopes to the sample solicitation).

11/23/11: In EPG 136.14.3.1 Commonly Used Forms, above, a link to Form 1590 FFATA was added.

10/21/11: In EPG 136.11.2 Consultant Construction Engineering Services, guidance was clarified about work (surveying) performed by a consulting engineering firm.

10/18/11: DBE goals are now required in all contracts, regardless of contract amount, as now reflected in EPG 136.6 Consultant Contracts.

10/5/11: In EPG 136.6.7 Supplemental Agreements, guidance for Supplemental Agreements has been clarified.

9/30/11: Fig. 136.6.7 Sample Solicitation was updated in EPG 136.6 Consultant Contracts by the addition of a "Submit" box that included the definition of a page.

9/29/11: The Obligation Request Form added to EPG 136.14.3.1 Commonly Used Forms.

8/23/11: In EPG 136.8.8.3 Deficiencies, the bridge ratings were corrected to bring the table into compliance with Bridge standards.

8/17/11: In EPG 136.6 Consultant Contracts, updated Fig. 136.6.1, Fig. 136.6.2, Fig. 136.6.7 and added new Engineering Services Sample Invoice spreadsheet.

8/11/11: In EPG 136, guidance was added to help users find info in the EPG. The video provides general guidance for MoDOT employees but it also is useful for other officials.

7/25/11: In EPG 136.7.2.2 Design Public Hearings, the reference to design public hearing being held for any job requiring a road closure was removed. It is no longer the practice.

7/6/11: A link to the NHI course, "Improving the Daily Diary", was added to EPG 136.11.7 General Documentation Requirements.

6/20/11: At the top of EPG 136.10 Construction Authorization and Letting, Fig 136.10.5 was updated to refer to 2011 specs rather than 2004 specs.

6/10/11: Expanded guidance, EPG 136.10.14 Request for Concurrence, has been provided to clarify an LPA's request for concurrence.

6/6/11: For greater clarity, two subtitles were entered to divide much of EPG 136.10.11 into EPG 136.10.12 Advertising and Addenda and EPG 136.10.13 Additive Alternates.

6/2/11: References to the 2004 specbook were updated in EPG 136.9.11, EPG 136.10 (in the article's text and in Fig. 136.10.1) and in EPG 136.13 Glossary. The last printed edition of the specbook is the 2011 edition. The latest specbook information will be available online.

5/23/11: Wage rate guidance in EPG 136.10.1 was clarified. New boilerplate document was added to EPG 136.10.2 so LPAs have a starting point for bid proposal documents.

5/6/11: Additional guidance regarding contracts exceeding $100,000 is provided at EPG 136.6.5 Evaluations.

5/4/11: In EPG 136.11.9, #1 was clarified and #2 updated.

4/28/11: No. 4 in EPG 136.11.6 was expanded and clarified.

4/13/11: Files available to non-MODOT agencies were updated in EPG 136.5 Agreements.

3/2/11: Added a link from the Additional Information box at the top of EPG 136.6 to the Allowable Profit Curve chart in EPG 134.3.

2/24/11: Updated the DBE Submittal Form and Disadvantaged Busn. Enterprise Program Form in EPG 136.14.3.1 Commonly Used Forms.

1/13/11: Numerous changes to EPG 136.2 from a recent FHWA audit include a new checklist and requires certification by the engineer of record. Also, it is now to be assumed that if rehabilitation costs are at least 68% of the replacement costs, the new replacement structure will provide a better value.

1/12/11: In EPG 136.4 Environmental and Cultural Requirements, a few links were updated and a link to Section 106 Survey Form was added.

1/7/11: In EPG 136.10.11 Bidder Qualification Language, the bid advertisement guidance was clarified.

1/7/11: In EPG 136.9.11 Plans, Specifications and Estimate (PS&E) Submittal, clarification about how many sets of plans the sponsor must submit.

1/7/11: In EPG 136.3.2 Highway Bridge Program (HBP) Project Selection, clarification about rehabilitation vs replacement. If the rehabilitation cost is at least 68% of the replacement costs, it can be assumed that replacing the structure will provide a better value than rehabilitation.

1/5/11: EPG 136.9.8 Work By Local Forces was clarified and a link was established to 23 CFR Subpart B, Section 635.201-205.

1/5/11: In EPG 136.6.4 Basis of Payment, guidance was updated on the retainage of Engineering Services Contracts.

12/16/10: In EPG 136.10, Fig. 136.10.1 Checklist for Bid Proposal was updated.

12/14/10: Additional guidance provided for progress invoices in the first paragraph of EPG 136.12.1 Progress Invoices.

12/1/10: Updated links to FHWA's Form 1273 in EPG 136.5 and EPG 136.11.18. In EPG 136.14.4, reworded the link to FHWA's Construction website. (Previously, it had been labeled as "Required Federal Aid Provisions".)

11/30/10: In EPG 136.6, Fig 136.6.1 Contract was updated to provide clear guidance to list subconsultants and the services they provide in the body of the contract.

11/12/10: In EPG 136.14.3.1, updated link to FHWA Form 1273.

11/12/10: EPG 136.10.8 was revised to bring it into compliance with federal obligation request verbiage.

10/14/10: In EPG 136.6, updated Fig 136.6.2 Consultant Selection Criteria.

10/5/10: In EPG 136.1.2.1 Procedures, the time allowed to bring an LPA project from allocation to award was shortened; EPG 136.6.2 was revised to ensure compliance with the Brooks Act, etc. since failure to comply with procedures may result in loss of funding; new retainage guidanace was added in EPG 136.9.9.5; and materials testing requirements in 136.11.9 Materials Testing were updated.

9/29/10: Updated District 3's Transportation Enhancements document in the Missouri map at EPG 136.14.1.1.

9/28/10: The former #18 (that allowed retainage) was removed to bring EPG 136.6.6 Contract Submittal into compliance with existing MoDOT policy. #19 was renumbered as #18.

9/28/10: In EPG 136.9.7 Estimates and EPG 136.10.11 Bidder Qualification Language, revised the listing of items to be subtotaled.
